Using SwayQ
These terms govern your access to and use of SwayQ's website and marketplace services, operated by SwayQ ApS (CVR 46300661, Copenhagen, Denmark). By using SwayQ, you agree to these terms.

Our service
SwayQ provides software and operational tools that help brands and creators discover each other, agree collaborations, and run those collaborations through to delivery. Payments are executed by our payment partner, Stripe, which holds the funds. SwayQ instructs the timing of a release and charges its own platform fee. We may update, suspend, or improve the service over time.
Platform role
SwayQ operates a marketplace. The contract for the content services is concluded between the brand and the creator. SwayQ is not a party to that contract, does not take title to any deliverable, and does not resell it. Questions of scope, conformity, quality, originality, legality, and performance of a deliverable are settled between the brand and the creator under their own agreement.
SwayQ is not the agent, employer, representative, or guarantor of any brand or creator. Creators are independent parties who set their own rates and choose which briefs to apply for. Nothing in these terms creates an employment relationship, an agency relationship, a partnership, or a joint venture between SwayQ and any user. SwayQ does not guarantee any user's performance, and does not warrant or guarantee campaign outcomes, reach, engagement, or commercial results.
Fees and payments
SwayQ is not a subscription service. Where applicable, we earn platform or transaction fees connected to campaigns, payments, or marketplace activity. Specific commercial terms will be shown before a transaction is confirmed.
Your responsibilities
- Provide accurate information and keep your account, profile, and payment details up to date.
- Use the platform lawfully and do not upload misleading, infringing, abusive, or fraudulent content.
- You remain responsible for your agreements, deliverables, tax obligations, and compliance with applicable marketing and disclosure rules.
Payment services
SwayQ facilitates campaign payments through our payment partner, Stripe. SwayQ is not a payment service provider, bank, or financial institution.
Stripe agreements
By using SwayQ's payment features, you agree to Stripe's terms of service. Creators accept the Stripe Connected Account Agreement. Brands accept Stripe's standard terms. These are separate legal agreements between you and Stripe.

Fund custody
Campaign funds are held by Stripe in regulated client money accounts. SwayQ does not hold, possess, or control campaign funds at any time.
Platform fee
SwayQ charges a platform fee on top of the creator rate. Brands pay the creator rate plus the platform fee at checkout. The creator receives the full agreed rate. The current fee schedule is available on our platform.
Payment hold and release
Campaign budgets are collected at campaign creation and held by Stripe. When a deliverable is submitted, a fixed review window opens on the agreed milestone schedule. If no dispute is raised inside that window, the funds release to the creator when it closes. Stripe holds the funds on the platform balance throughout. This protects both brands and creators.
Refund policy
Refunds are processed through Stripe. SwayQ does not decide whether a creator performed their side of the agreement, and has no discretion over the outcome of a disagreement between a brand and a creator about a deliverable. What SwayQ operates is the mechanics. Campaign funds that were never allocated to a creator return to the brand. A deliverable disputed inside the review window pauses the release, and the release then follows the amount the brand and the creator agree on. If they ask SwayQ to help, SwayQ mediates and records the amount they settle on, capped at the amount originally agreed. SwayQ does not rule on whether a deliverable met the brand's requirements. Stripe processing fees may not be refundable.
Liability
SwayQ is provided on an as-available basis. To the maximum extent allowed by law, SwayQ is not liable for indirect, incidental, or consequential losses, or for disputes between users, except where liability cannot be excluded under applicable law.
Governing law
These terms are governed by Danish law. Any disputes will be handled by the competent courts of Denmark unless mandatory law requires otherwise.
